Our client may be released to a war zone

Last night, we received news that the Trump administration will release our client, a U.S. citizen who has been illegally detained in Iraq without charges for almost nine months. But instead of releasing him safely, the administration is giving him a death sentence: releasing him in Syria, without a passport, ID, or any assurances of protection.

Add your name now to demand that Defense Secretary James Mattis stop this death sentence and ensure the safe release of our client.

The ACLU sued Secretary Mattis for allowing the U.S. military to unlawfully detain this American citizen without charges. The citizen was fleeing violence in Syria when he was detained and beaten by Kurdish forces, and then handed over to the U.S. military. Now, our fight for our client's right to due process is also a fight for his right to life.

The Department of State has classified travel to Syria as a "Level 4: Do Not Travel" threat, encouraging citizens to "draft a will" in the event that they decide to not heed the government's warning. The Trump administration won't even deport Syrians from the U.S. to Syria because it said that doing so "would pose a serious threat to their personal safety." So then why would the administration not follow its own advice and deliberately send an American to a war zone?

After illegally denying this citizen due process, the administration is now planning to leave him on the side of the road, with no way of safely returning home.

We'll be filing an emergency request for a temporary restraining order against the military the court will soon rule on whether to deny the Trump administration's attempt to release our client in Syria. Both the court and the Trump administration need to hear that this is no way to treat an American citizen.
