It's Robert the owner. With everything happening in Texas and in
Washington, you deserve to hear where things actually stand. So here it is.
Texas: after five years, the state finally won.
Since 2021, a court order protected delta-8 in Texas. This year the state
took it apart piece by piece, and as of July 31, Texas stores can no
longer sell delta-8, THC-P, or almost any THC product. If you're in
Texas, you've already watched the shelves emptying and they're not
coming back.
Here's what that ban actually is and isn't.
The ban is on Texas stores selling. Possessing these products was NOT
criminalized. Owning them is not a crime. They can't do anything to stop
you from ordering online from out to state due to the fact these products are
still federally legal under the 2018 farm bill.
And we can still get them to you.
This company grew up in Texas half of you have been with us since the
early days there. A while back we opened our fulfillment center in Nevada,
and that facility can keep shipping to Texas under the federal law that
protects hemp shipments between states.
So here's our commitment, plainly: as long as the payment processors
allow it, we will keep selling to Texas and if they ever tell us we
can't, we'll be working on other ways to accept payment before you even
hear about it. We've fought for five years. This is not where we quit.
The federal fight is going better than the headlines.
The law Congress passed last year would effectively ban hemp THC
nationwide in November, but it was written so broadly it would take down
the CBD industry too, and that overreach triggered a real, bipartisan
effort to fix it before it takes effect.
We're closer to this fight than most, and here's my honest read: the most
likely outcome trades the ban for FDA review and, eventually, per-serving
caps, possibly as low as 5mg. If that's how it lands, we'd expect at
least another year of full-strength products before any cap could
realistically kick in (and the FDA is not famous for speed).
Translation: the high-mg era isn't ending in November. But it may not
last forever, either. You'll hear every development from me first,
good or bad.
About most of our gummies being out of stock, I owe you an apology.
A lot of you have noticed favorites out of stock lately. With all this
regulatory chaos, keeping production moving has been a mess, and you've
felt it. I'm sorry. The good news: restocks are in motion, and most
items should be back over the next few weeks some new flavors are
coming with them.
