CPD Webinar – Exploring Director Liability

1 CPD Unit – Substantive Law

Limited liability companies, including proprietary limited (Pty Ltd) entities, are frequently recommended by professional advisers as a “safe” and effective business structure. From an asset protection perspective, they can offer significant protection for business owners and directors.

However, when a company fails, directors may still face personal liability in a range of circumstances. For legal practitioners and accountants advising clients, understanding these risks and the strategies that may help minimise personal exposure is essential.

In this webinar, Exploring Director Liability, Dino Travaglini of Travaglini Corporate Advisory provides valuable insights into the personal financial risks company directors may face. He outlines the key issues advisers and legal practitioners should be discussing with their clients to help them better understand, manage, and reduce these risks.

In this webinar, Dino will cover:

  • Personal liability of directors for unpaid company taxes;
  • Personal liability of directors for unpaid company superannuation;
  • Nature of the personal liability owing to the ATO;
  • Personal exposure under the Corporations Act when a company fails, including:
    • Insolvent trading;
    • Anti-phoenixing provisions; and
    • Breach of directors duties;
  • Personal guarantees & risks to the family home under charging clauses; and
  • Director/shareholder loan accounts.

This webinar is suitable for company directors, legal practitioners, accountants and other professional advisers and is pitched at an entry level. It is ideal for company directors and any professional advising on business structures for their clients.

The webinar runs for 1 hour and is being held on Wednesday, 3 June, 12:00 Noon Eastern Standard Time (10:00 AM WST). The cost is only $120. Click here to register.
