The Australian tax system provides a range of concessions, exemptions, and planning opportunities that may be available to executors and estates in the course of administration. When properly understood and applied, these rules can assist executors in preserving estate value, managing tax outcomes more effectively, and ensuring that distributions are made in a way that is both compliant and tax-efficient.

However, the decisions and actions executors and other legal personal representatives make can have significant tax consequences, sometimes in circumstances where the risks are not immediately obvious. Missteps in dealing with estate income, capital gains tax events, or outstanding liabilities can expose the estate, and even the representative personally, to significant consequences. A clear understanding of the tax obligations is therefore essential to effective estate administration.

In this webinar, Accredited Specialist in Wills and Estates Law, Lachlan Einsiedel from Suzanne Lyttleton Lawyers, will examine the taxation framework applying to deceased estates and legal personal representatives. He will outline the key issues advisers, legal practitioners and their clients should consider to assist in better understanding, managing, and reducing the risks inherit in administering an estate.

In this webinar, Lachlan will cover:

  • Tax obligations of legal personal representatives;
  • Risk areas for estates and legal personal representatives, including:
    • Dealing with director penalty notices;
    • CGT K3 Events and consequences of foreign beneficiaries in the estate plan;
    • Use of income streaming.

Lachlan has practised exclusively in wills and estates law, and VCAT guardianship and administration since his admission as a solicitor. Consecutively in 2023, 2024 and 2025, he was recognised by Doyles Guide as a Rising Star for Wills and Estates and is an Accredited Specialist in Wills and Estates Law.

Lachlan’s expertise encompasses estate planning, VCAT administration and financial investigations, VCAT disputes in the guardianship and administration list, and estate litigation.

In addition to his Bachelor of Laws, Lachlan holds a Bachelor of Commerce (Accounting) and is a Chartered Tax Adviser with the Tax Institute of Australia. He uses his tax and accounting expertise to assist clients achieve positive commercial outcomes – whether that is by providing pragmatic tax advice in the context of estate planning, estate administration and litigation; or being able to analyse complex financial arrangements and undertake financial investigations.

Lachlan works collaboratively with his clients to ensure they are fully informed about where they stand, with a focus on resolving disputes in a timely and cost-effective manner.
