Are sex clubs legal in Canada?
Yes, sex clubs are legal in Canada as long as they are operating as private members clubs. This means that each person entering the venue must first become a member of the establishment, agreeing to the venue rules.
Historically, sections 210-211 of the Criminal Code of Canada prohibit the operation of a “bawdy house” (a place kept, occupied or used for the purpose of prostitution or act of indecency). However, the Supreme Court of Canada struck down these provisions in 2013, leading to the enactment of Bill C-36 (Protection of Communities and Exploited Persons Act) in 20214, which shifted the focus to penalizing the purchase of sexual services. Section 174 of the Criminal Code addresses acts of public indecency. According to this section, it is an offense for anyone to willfully commit an indecent act in a public place.
In Canada, sex clubs avoid the risk of public indecency offenses by enforcing membership policies so that sexual activities are occurring in private rather than public settings. Membership policies typically include agreements or contracts that outline acceptable behaviour within the club and involve a membership fee.
What is the etiquette of attending a sex club?
Each sex club has its own set of rules and etiquette guidelines to ensure a respectful and enjoyable experience for all guests. A fundamental principle among sex clubs is consent. All interactions must be consensual and sex clubs often have staff to monitor interactions and behaviours. Many clubs prioritize the privacy and anonymity of their members and guests, and therefore prohibit the use of phones and other recording devices. Some clubs have other safety and hygiene measures in place, such as the provision of safe sex supplies. The dress code from sex club to sex club can vary broadly, anything from casual to fetish wear. Most sex clubs, in Canada and abroad, have a website which clearly states their rules.
